GUYS! THIS IS THE FUNNIEST THING, EVER! SOMEBODY BOUGHT LOTR and Twilight fanfiction archives in an attempt to monetise the whole thing. Yes, this is like fanlib part 2. This is going to be so funny!

No irony - I laughed so hard when I heard this.

Oh, I can't wait for the law suits to start!!!!

BE GLEEFUL ON BOTH FRONTS! As far as I can tell, ficwriters are abandoning ship, and people with half a wit is trying to get out of the explosion range. The sheer stupidity is awesome.

Also, he got his company registered in the UK. You know, the country with one of the NARROWEST COPYRIGHT/IP LAW!!! This is going to be GLORIOUS!

It always surprises me that people don't hire a lawyer before making stupid business decisions. This is is just sheer stupidity on multiple levels.

People don't hire lawyers because we are scary and expensive. In this case I'd suspect Mander didn't think about the difference in copyright laws and thought fair use applies to everything (you won't believe how many people in Oz I've had to disabuse of that idea).

That's just stupid, especially when I imagine this guy had enough capital to purchase the sites to begin with. Lawyers and accountants are a necessity when starting a business.

To be fair to the guy, he is based in the UK according to his (openly linked PDF) resume. Brighton, to be exact.

It's just that he's an utter muppet who hasn't really done anything outside the rather narrow fields of advertising, corporate dick-waggery, and site-flipping, so he has no idea of the amount of trouble he's precipitated himself into.

I love this term - corporate dick-waggery. I think I shall be using it from now on.

It is really difficult to feel sorry for the guy when all his actions has been rather dumb. Then again, he is probably not that aware, or have much common sense, and is operating under the assumption that all the women in fandom are dumber than he, or at the very least slightly hysterical (which I suppose I can see).

Either way, this ought to be interesting.

(Thanks for letting me know. I was slightly thrown by some of the cocmmenters as I don't know them.)

Bonus round is when, during the initial copyright suits, someone notices that due to a legal decision a few years back it's a criminal offence in the UK to depict or distributing any depiction of sexualised violence. With the courts being especially severe when it comes to depictions of sexual acts, violent or otherwise, involving minors.

There's in fact a distinct chance this will end with this guy on the sex offenders register.

Of course the unfunny comes with how the UK tabloid press would cover such a case, leading to the tolkien estate having to get VERY hardcore about "those vile child molesting slashers" due to fears about the unfortunate association the tolkien brand might get attached to it.

What legal decision is that, citation and link if possible? Professional curiosity. In Australia we had a decision over cartoon child porn that clarified that the child porn criminal law to fictional characters.

I was about to reply that I was wrong, and that what I was thinking of was the 2008 criminal and justice act, which only illegalises images and video depicting bestiality, necrophilia, snuff and violent acts upon "breasts, anuses and genitals" that could reasonably be mistaken for the real deal.

However what it turned out I was in fact remembering was the Girls Aloud obscenity case from 2009, which it turns out was withdrawn by the prosecution because the person who wrote it was sufficiently hard to accidentally find via searches and had put up "sufficient" barriers (one assumes a cut tag with warnings of some kind) to stop people "easily" getting access to it.

However, that case does seem to indicate that the Obscene Publication Act 1964 is still in effect in the UK, and can be used to prosecute written depictions of "obscene" acts and people "publishing" them (which would cover criminal action against the owner of a fanfic archive if they were based in the UK), with the, in this case deeply ironic, kicker that SaruMander here couldn't be prosecuted under that act unless he seeked "to gain" by publishing the obscene material and took actions to SEO his fanfic archives.

So in a stroke, by doing nothing but moving his new potential fanfic conglomeration business to the UK and trying to make a profit from the fanfic sites he's buying up, he has opened himself up to:

- Legal action by the Tolkien Estate.
- Legal action from Disney vast and deathless legal department.
- Legal action from Stephanie Meyer's sparkly lawyers.
- Legal action by the UK criminal courts on behalf of Her Majesty Elizabeth II Regina

and worst of all;

- pissed off a fandom that has already started writing elf/pooh slashfics in direct response to his shenanigans.

...I now honestly doubt taht even Kali herself in her Mahakali form would have either faces or palms sufficient in number to adequately facepalm in response to this.
